These are the terms on which AVA sells. They apply to every order placed on this website.
Who we are
AVA is a women's clothing and intimates brand based in Dhaka, Bangladesh. In these terms, "we", "us" and "AVA" mean the business; "you" means the person placing the order.
Placing an order
You do not need an account. You add pieces to your bag, give us a name, a phone number and a delivery address, and confirm.
An order placed on the website is a request to buy, not yet a contract. Someone from AVA calls you to confirm the order and the address before it is packed. The contract is formed at that call. Until then, either of us may cancel without cost.
We may decline an order — if a piece has sold out between your order and our call, if the address is outside our delivery area, or if we cannot reach you after reasonable attempts. If we decline an order you paid for online, we refund it in full.
Prices
All prices are in Bangladeshi Taka and include VAT where it applies. The delivery charge is shown separately at checkout and is included in the total you are asked to pay. Nothing is added afterwards.
We may change prices at any time, but never after your order has been confirmed on the call.
Paying
You can pay cash on delivery, handing the money to the delivery person when your parcel arrives, or online at checkout by card, bKash, Nagad or other mobile banking through SSLCommerz, a licensed payment gateway in Bangladesh. Online payments are made on SSLCommerz's secure page; AVA never sees or stores your card details.
We will never ask for your card number, PIN or OTP over the phone.
Delivery
We deliver across Bangladesh. Charges and timings are set out on our shipping information page. Delivery dates are estimates given in good faith, not guarantees.
Risk in the goods passes to you when the parcel is handed over.
Stock and images
Pieces marked Available can be ordered; some are sourced after you order. Occasionally a piece cannot be supplied after all; if that happens we will tell you on the call and cancel or substitute as you prefer, and refund in full anything you paid online.
Colours vary between screens. We photograph our garments as faithfully as we can, but a shade on your phone may not be the shade in your hand, and that alone is not a fault.
Cancelling
You may cancel any order before it has been dispatched by calling us with your order number. If you paid online, the full amount is refunded within 7–10 working days. Once a parcel has left us it can no longer be cancelled, and becomes a return instead.
Returns
Returns and refunds are set out in full in our return & refund policy, which forms part of these terms. Refunds are made within 7–10 working days.
Our responsibility to you
If we get something wrong we will put it right — by replacing the piece, exchanging it, or refunding you. Our liability for any order is limited to what you paid for it, including delivery.
Nothing in these terms limits any right you have under the consumer protection law of Bangladesh.
Using this website
The photographs, text and designs on this site belong to AVA. You are welcome to share them; please do not sell them or present them as your own.
Governing law
These terms are governed by the law of Bangladesh, and any dispute is subject to the courts of Dhaka.
Changes
We may update these terms. The version that applies to your order is the one published on the day you placed it. The date at the top of this page shows when it last changed.
